Axis Express & Logistics Pvt Ltd has been giving services to its clients by carrying Documents / Parcels for delivery to the various destinations under the following terms & Conditions:
The currency, bearer cheques, hundies, bearer bilty and/or similar other documents, Gold, Silver, Jewellery, Precious stones, Liquid, Semi Liquid perishable/fragile goods narcotics and / or any item which are prohibited and/or restricted by statutory law and acts are strictly not accepted by us. If such articles are enclosed without our information, the Company/Franchisee will not be liable for the same and no claim shall be entertained for such articles.
Axis Express does not deliver the documents to a P.O. Box address. Documents / Parcels booked by the service seeker are delivered to the consignee / person who accepts on their behalf, at the given address, is deemed to be delivered to the consignee and the acknowledgment is obtained. Once the consignee receives the document / parcel and signs on the proof of delivery (POD), it is assumed that the consignee has received the document/parcel intact, after that, any claim will be treated void.
Axis Express may avail any type of transportation for smooth and quicker delivery. Axis Express will not be in a position to ‘hold’ or return documents in transit for any reason, for the explicit purposes of resolving any dispute between the service seeker and their customers.
Said to Contain Basis: All the consignment shall be booked on “said to contain basis” i.e. Axis Express shall be under no obligation to verify the description and contents of the shipment declared by the consignor on the docket/Invoice and as such the consignor shall undertake and ensure to make correct and factual declaration on the docket/airway bill. Consignor indemnified and would keep indemnified Axis Express, its directors and employees against all claims, losses, charges and expenses incurred by Axis Express due to any banned, restricted or dangerous items entering in to the network of the Axis Express due to any omission or commission of consignor. however Axis Express reserve the right to inspect and/or refuse booking of shipment not conforming to theses terms and condition, only after duly informing consignor regarding the reasons for such inspection and/or refusal and after receiving the confirmation from consignor.
No complaint / claim shall be entertained by the Company / Franchisee after the expiry of 15 days from the date of booking consignment.
In case of loss, theft, damage and mishandling of booked consignment maximum liability of the Company/ Franchisee shall not be exceeding to the sum equivalent to five times of freight charges for un-insured documents and five times of freight charges for un-Insured parcels, in any case.
In case of valuable parcel consignor should declare the value and pay the valuation charge @ Rs.10/- per valuation of Rs.1000/- and Insurance charges for articles to be insured, otherwise no claim will be considered as per terms No.2.
All disputes & claims are subject to the exclusive and irrevocable jurisdiction of courts in Mumbai only.
The terms and conditions continued here above will be subject to change from time to time based on need and on any new service being offered by Axis Express and Axis Express reserves the right to change, amend or cancel, any of the clauses.
The company reserves the right to entrust the goods to any other carrier. The company/franchisee will not be liable for any delay, damage or loss-during its transit through other carrier of situation beyond our control i.e. occurred due to acts of God or Man–made calamities.
Axis Express has the right but not the obligation to open and/or inspect the shipment.
Axis Express reserves the right to refuse shipments not conforming to these terms and conditions without assigning any reason whatsoever.
All taxes such as Octroi and other statutory payments levied on the shipments are to be borne by the CONSIGNEE and in his absence the same will be borne by the SHIPPER. Axis Express will not extend any credit for Octroi and other statutory charges.
THE SHIPPER acknowledges Axis Express right of lien on its shipments for any outstanding freight, any other applicable charges, Central, State and Local taxes, duties, levies, advances arising out of transportation and warehousing services, whether pertaining to past or present outstanding, in respect of any or all shipments carried under this Contract and may refuse to surrender possession of the shipments until all such charges are paid.
Axis Express shall not be liable in any event for any consequential or special damages or other direct or indirect loss howsoever arising, whether or not Axis Express has knowledge that such damages might be incurred, including but not limited to loss of income, profits, interest, utility or loss of market.
Due to acts of God, force majeure occurrence of any cause reasonably beyond the control of Axis Express, or loss and damage caused through strikes, riots, political and other disturbances such as fire, accident of the vehicle carrying the goods, explosions, beyond the control of Axis Express for the goods that are carried by Axis Express.
Classified as hazardous material, dangerous goods, and prohibited, banned or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), any applicable government department or other relevant organization.
